CHILD SAFE POLICY
Hive Active Pty Ltd (ABN 81 614 730 184) has adopted the following Child Safe Policy.
1. Purpose and scope
1.1 Hive Active is committed to the safety, wellbeing and best interests of all children and young people who participate in its programs, classes, recovery services and other activities.
1.2 This Policy establishes the framework through which Hive Active implements the NSW Child Safe Standards under the Children's Guardian Act 2019 (NSW) and demonstrates its commitment to creating and maintaining a child safe culture.
1.3 This Policy applies to all directors, employees, contractors, volunteers, students on placement, and any other person acting on behalf of Hive Active who has contact with children or young people in the course of Hive Active's operations.
2. Definitions
2.1 In this Policy:
(a) Child or young person means any person under the age of 18 years.
(b) Child abuse includes physical abuse, sexual abuse, emotional or psychological abuse, neglect, and exposure to family violence.
(c) Child safe organisation has the meaning given in the Children's Guardian Act 2019 (NSW).
(d) Child Safe Standards means the ten Child Safe Standards set out in the Children's Guardian Act 2019 (NSW) and associated guidelines issued by the NSW Office of the Children's Guardian.
(e) Reportable conduct has the meaning given in the Children's Guardian Act 2019 (NSW).
(f) Staff member means any director, employee, contractor, volunteer, or student on placement engaged by or working with Hive Active.
(g) Working With Children Check (WWCC) means the check required under the Child Protection (Working with Children) Act 2012 (NSW).
3. Statement of Commitment
3.1 Hive Active is committed to:
(a) the safety, wellbeing and best interests of all children and young people;
(b) creating and maintaining a child safe culture across all programs, services and facilities;
(c) implementing and embedding the NSW Child Safe Standards in its governance, operations and day-to-day practices;
(d) ensuring children and young people are heard, respected and involved in decisions that affect them;
(e) providing an inclusive, equitable and supportive environment for all children and young people, including Aboriginal and Torres Strait Islander children, children with disability, children from culturally and linguistically diverse backgrounds, and LGBTIQA+ young people;
(f) taking all reasonable steps to prevent child abuse and harm; and
(g) responding promptly, transparently and appropriately to any concerns, disclosures or allegations of child abuse or harm.
4. The NSW Child Safe Standards
4.1 Hive Active implements the ten NSW Child Safe Standards as follows:
(a) Standard 1 – Child safety is embedded in leadership, governance and culture: The management of Hive Active take responsibility for child safety. This Policy is endorsed by the Director and reviewed at least annually. Child safety is a standing agenda item at relevant management meetings.
(b) Standard 2 – Children and young people are informed about their rights, participate in decisions affecting them, and are taken seriously: Hive Active provides age-appropriate information to children and young people about their rights, including the right to feel safe and to raise concerns. Feedback from children and young people is actively sought and considered.
(c) Standard 3 – Families and communities are informed and involved: Hive Active communicates openly with parents and guardians about child safety practices, this Policy, and how to raise concerns. This Policy is publicly available on Hive Active's website and at its premises.
(d) Standard 4 – Equity is upheld and diverse needs are taken into account: Hive Active recognises that some children face additional risks and tailors its safeguarding practices to address the needs of children from diverse backgrounds, children with disability, and other vulnerable groups.
(e) Standard 5 – People working with children are suitable and supported: Hive Active implements safe recruitment, screening and induction practices (see clause 5). All staff members working with children receive appropriate training and ongoing support.
(f) Standard 6 – Processes to respond to complaints of child abuse are child-focused: Hive Active maintains a clear, accessible and child-focused complaints process (see clause 7). Children and young people are supported throughout any complaint or reporting process.
(g) Standard 7 – Staff are equipped with the knowledge, skills and awareness to keep children and young people safe through continual education and training: All staff members receive child safety training at induction and at least annually thereafter. Training covers recognising indicators of abuse, responding to disclosures, and mandatory reporting obligations.
(h) Standard 8 – Physical and online environments minimise the opportunity for abuse to occur: Hive Active maintains safe physical environments at its Roseville premises and, where applicable, safe online environments. Risk assessments are conducted regularly to identify and address potential hazards.
(i) Standard 9 – Implementation of the Child Safe Standards is continuously reviewed and improved: Hive Active reviews this Policy and its child safe practices at least annually, or following any incident, complaint or significant change to operations.
(j) Standard 10 – Policies and procedures document how the organisation is child safe: This Policy, together with Hive Active's Code of Conduct, complaints procedure, and recruitment and screening procedures, documents how Hive Active meets its child safe obligations.
5. Recruitment, screening and induction
5.1 Hive Active requires all staff members who work with children or young people to hold a valid Working With Children Check (WWCC) clearance before commencing work or volunteering.
5.2 Hive Active will:
(a) verify each staff member's WWCC clearance prior to commencement and at each renewal;
(b) maintain a register of WWCC clearances for all relevant staff members;
(c) conduct reference checks for all new staff members who will have contact with children; and
(d) provide child safety induction training to all new staff members before they commence work with children or young people.
5.3 No person who is barred from working with children under the Child Protection (Working with Children) Act 2012 (NSW) or any equivalent legislation will be engaged by Hive Active in any capacity involving contact with children.
6. Code of Conduct for Interactions with Children
6.1 All staff members must, when interacting with children and young people:
(a) treat children and young people with respect, dignity and fairness at all times;
(b) maintain appropriate physical and emotional boundaries;
(c) avoid one-on-one situations with a child or young person that are not visible to others, unless in an emergency;
(d) use appropriate language and avoid any communication that could be considered offensive, demeaning or inappropriate;
(e) not photograph or film children or young people without the prior written consent of their parent or guardian;
(f) not share images of children or young people on social media or other platforms without the prior written consent of their parent or guardian;
(g) not communicate with children or young people via personal social media accounts or personal messaging applications;
(h) report any concerns about a child's safety or wellbeing to the Policy Owner immediately; and
(i) not engage in any behaviour that constitutes child abuse or that could reasonably be perceived as grooming.
6.2 Breaches of this Code of Conduct will be treated seriously and may result in disciplinary action, including termination of employment or engagement, and referral to relevant authorities.
7. Recognising and Responding to Concerns and Disclosures
7.1 Any staff member who:
(a) observes behaviour that raises concerns about a child's safety or wellbeing;
(b) receives a disclosure from a child or young person about abuse or harm; or
(c) suspects that a child or young person has been or is at risk of being abused or harmed,
must report their concern immediately to the Policy Owner.
7.2 When responding to a disclosure from a child or young person, staff members must:
(a) listen calmly and without judgement;
(b) reassure the child that they have done the right thing by speaking up;
(c) not promise confidentiality;
(d) not investigate or ask leading questions;
(e) record what was said as soon as practicable using the child's own words; and
(f) report the disclosure to the Policy Owner immediately.
7.3 The Policy Owner is responsible for:
(a) assessing the concern or disclosure and determining the appropriate response;
(b) making a report to the NSW Police (131 444) or the Department of Communities and Justice (Child Protection Helpline: 132 111) where there are reasonable grounds to suspect a child is at risk of significant harm;
(c) notifying the NSW Office of the Children's Guardian of any reportable conduct allegations in accordance with the Children's Guardian Act 2019 (NSW); and
(d) supporting the child and their family throughout the process.
7.4 All concerns, disclosures and reports must be documented and retained securely in accordance with Hive Active's privacy and records management obligations.
8. Mandatory Reporting
8.1 Certain staff members may be mandatory reporters under the Children and Young Persons (Care and Protection) Act 1998 (NSW). Mandatory reporters include, but are not limited to, registered health practitioners (including remedial massage therapists registered with AHPRA).
8.2 A mandatory reporter who, in the course of their work, has reasonable grounds to suspect that a child is at risk of significant harm must report that suspicion and the basis for it to the Child Protection Helpline (132 111) as soon as practicable.
8.3 Hive Active will support all mandatory reporters in meeting their obligations and will not take any adverse action against a staff member for making a report in good faith.
9. Safe Physical Environments
9.1 Hive Active will take reasonable steps to ensure its Roseville premises are physically safe for children and young people, including by:
(a) conducting regular risk assessments of all areas accessible to children and young people;
(b) ensuring adequate supervision ratios when children and young people are present;
(c) maintaining clear sightlines in areas used by children and young people where practicable;
(d) securing areas that are not appropriate for children and young people to access; and
(e) ensuring all equipment used by children and young people is safe and fit for purpose.
10. Privacy and Confidentiality
10.1 Hive Active collects and handles personal information about children and young people in accordance with the Privacy Act 1988 (Cth) and the Privacy and Personal Information Protection Act 1998 (NSW).
10.2 Information about a child or young person will only be shared with third parties where:
(a) the child's parent or guardian has consented;
(b) it is required or authorised by law; or
(c) it is necessary to protect the safety or wellbeing of the child or another person.
10.3 All records relating to child safety concerns, disclosures and reports will be stored securely and accessed only by those with a legitimate need.
11. Training and Awareness
11.1 Hive Active will ensure that all staff members:
(a) receive child safety training at induction, covering this Policy, the Child Safe Standards, recognising indicators of abuse, responding to disclosures, and mandatory reporting obligations;
(b) complete refresher training at least annually; and
(c) are made aware of any updates to this Policy or relevant legislation.
11.2 Training records will be maintained by the Policy Owner.
12. Review and Continuous Improvement
12.1 This Policy will be reviewed at least annually by the Policy Owner and endorsed by the Director of Hive Active.
12.2 Reviews will also be triggered by:
(a) any incident, complaint or allegation involving a child or young person;
(b) changes to relevant legislation or the Child Safe Standards; or
(c) feedback from staff members, children, young people or their families.
12.3 The outcomes of each review, including any changes made to this Policy or related procedures, will be documented and communicated to all staff members.
13. Breaches of this Policy
13.1 Any breach of this Policy will be taken seriously. Depending on the nature and severity of the breach, Hive Active may:
(a) provide additional training or supervision;
(b) take disciplinary action, up to and including termination of employment or engagement; and/or
(c) refer the matter to the NSW Police, the NSW Office of the Children's Guardian, or other relevant authorities.
